Clearing obstacles to equal access on Hungarian public transport

Hungarian Ombudsman files a petition to the Constitutional Court about the amended regulation of the obstacle-clearance of the public transportation

The Commissioner for Fundamental Rights observed that the Act on person transportation services does not guarantee the right to access to the public transportation with respect to the equal opportunities principle and also it involves only the gradual implementation of the obstacle-clearance of the public transportation instead of a definitive deadline. Due to that, the Commissioner for Fundamental Rights requested the Constitutional Court to review the provision.

In his petition to the Constitutional Court, ombudsman Máté Szabó recalled that the Hungarian legal regulation has to comply with the international treaties whereas the amendment regulation violates the UN Convention on the Rights of Persons with Disabilities as well as the principle of human dignity, the principle of freedom of movement and the free choice of place of residence. As a result, the Commissioner for Fundamental Rights requested from the Constitutional Court the annulment of the amended regulation on the basis of incompatibility with an international treaty.
