The Court of Justice of the EU decided that it does not have jurisdiction to give a preliminary ruling on a reference by the Bulgarian equality body, the Commission for Protection against Discrimination.

In today’s Grand Chamber judgment in the case of X and Others v. Austria (application no. 19010/07), which is final, the European Court of Human Rights held, that there had been a violation of Article 14 (prohibition of discrimination) taken in conjunction with Article 8 (right to respect for private and family life) of the European Convention on Human Rights on account of the difference in treatment of the applicants in comparison with unmarried different-sex couples in which one partner wished to adopt the other partner’s child.
In today’s Chamber judgment in the case of García Mateos v. Spain (application no. 38285/09), which is not final, the European Court of Human Rights held, unanimously, that there had been a violation of Article 6 § 1 (right to a fair hearing within a reasonable time) combined with Article 14 (prohibition of discrimination) of the European Convention on Human Rights.
